Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and Starclaim (“Starclaim,” “we,” “us,” or “our”) governing your access to and use of the Starclaim game, website, and related services (the “Service”). By accessing or using the Service, you agree to these Terms and to our Privacy Policy and Disclaimer. If you do not agree, do not use the Service.

1. Acceptance & changes

We may modify these Terms or the Service at any time. If a change is material, we will update the “Last updated” date above and, where reasonably practical, provide additional notice. Your continued use after a change takes effect means you accept the revised Terms. If you do not agree, stop using the Service.

2. Who may use Starclaim

The Service is intended for a general audience and is not directed to children under 13 (or the minimum age of digital consent in your jurisdiction, which may be higher). By using the Service you represent that you meet this age requirement and that you are able to form a binding contract, or that a parent or legal guardian agrees to these Terms on your behalf. We may restrict or terminate access where this is not the case.

3. Your account

You can play as a guest or create an account using an email address or a third-party sign-in such as Google. You are responsible for activity that occurs under your account and for keeping your credentials secure. You agree to provide accurate information and not to impersonate others or create accounts to evade restrictions. We may suspend or terminate accounts as described in Section 14.

4. License to use the Service

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for your own non-commercial entertainment. You may not sell, sublicense, or commercially exploit the Service or any part of it except as expressly permitted.

5. Virtual items and Stardust — no real-money value

The in-game currency (“Stardust”) and any territory, titles, names, or other in-game items are virtual items licensed to you, not property you own. They have no monetary value, are not sold for real money, and cannot be sold, transferred outside the Service, redeemed for cash, or exchanged for anything of value. Stardust is not a deposit, credit, security, stored-value instrument, or prize.

The optional Supporter Boost described in Section 7 is not a purchase of Stardust or of any in-game item. It is an optional payment that temporarily increases your Stardust production rate — the same boost you can obtain for free by turning on ads (Section 6) — and it grants no Stardust balance, territory, or competitive advantage beyond that time-limited production rate.

We may create, grant, adjust, revoke, expire, or reset Stardust and other virtual items at any time, including when we reset or rebalance the game, and except where required by law you are not entitled to any refund or compensation for virtual items.

6. Advertising and rewards

The Service may offer an optional boost to your in-game Stardust production that you can activate for free by turning on ads, or support directly through the optional paid Supporter Boost (Section 7); both grant the same boost, and neither is ever required to play. Ads are served by third-party advertising partners under their own terms and privacy practices, and we are not responsible for their content. Rewards and boosts have no real-world value (see Section 5).

7. Purchases, the Supporter Boost & refunds

Starclaim is free to play, and no purchase is ever required. As an optional way to support the game, you may make a one-time purchase of a “Supporter Boost.”

8. User content

You are responsible for the names, labels, and other text you submit (for example, empire, galaxy, and system names) (“User Content”). You retain whatever rights you have in your User Content, and you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, and use it to operate, promote, and improve the Service. You represent that you have the rights to submit your User Content and that it does not violate these Terms or any law.

You must not submit content that is unlawful, infringing, deceptive, hateful, harassing, threatening, defamatory, obscene, sexually explicit, or that contains another person’s private information. We may review, moderate, refuse, remove, or rename User Content at our discretion, and we may suspend accounts that violate this Section. We respond to valid intellectual-property complaints (including DMCA-style notices) sent to support@starclaim.space.

10. The shared, competitive world

Starclaim is played on a shared map. Territory you hold may be claimed or contested by other players, and the universe (including your progress) may be reset, rebalanced, wiped, or discontinued at any time. Because Stardust and in-game territory have no cash value, losing or contesting them carries no monetary loss. Any optional purchases you make are governed by Section 7.

11. Intellectual property

The Service, including its software, code, visual design, generated artwork, audio, and branding, is owned by us or our licensors and is protected by intellectual-property laws. Except for the limited license in Section 4, we grant you no rights in the Service or its content. The procedurally generated universe is fictional (see the Disclaimer).

12. Third-party services

The Service relies on third parties (for example, authentication and database providers such as Supabase, third-party sign-in such as Google, hosting/CDN, analytics, advertising partners, and payment processing by Stripe). Your use of those features may be subject to the third party’s terms and privacy practices. We are not responsible for third-party services, and links to external sites are provided for convenience only.

13. Disclaimers & limitation of liability

The Service is provided “as is” and “as available”without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that progress will be preserved. To the maximum extent permitted by law, we and our suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, progress, or virtual items. Our total liability to you for any claim is limited to the greater of (a) the total amount you paid us in the 12 months before the event giving rise to the claim or (b) USD $50, except where such limitation is prohibited by law. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

14. Suspension & termination

You may stop using the Service at any time. We may suspend or terminate your access, remove content, or reset progress at our discretion, including for violations of these Terms or to protect the Service or other players. Sections that by their nature should survive termination (including Sections 5, 7, 8, 11, 13, 15, and 16) will survive.

15. Indemnification

To the extent permitted by law, you agree to indemnify and hold us harmless from claims, losses, and expenses (including reasonable legal fees) arising out of your User Content, your use of the Service, or your violation of these Terms or applicable law.

16. Governing law & dispute resolution

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-laws rules. Before bringing any formal claim, you agree to first try to resolve the dispute informally by contacting us at support@starclaim.space and giving us at least 30 days to resolve it in good faith. Any dispute that is not resolved informally will be brought exclusively in the state or federal courts located in Texas, and you and we consent to the personal jurisdiction and venue of those courts. Nothing here prevents either party from seeking injunctive or equitable relief in any appropriate court for intellectual-property infringement or unauthorized access to the Service.

17. General

These Terms, together with the Privacy Policy and Disclaimer, are the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
